Syed Hamid: Don't regard criminals as heroes

PUTRAJAYA, Jan 28 — The people should not regard criminals as heroes and the police who enforce the law as demons, Home Minister Datuk Seri Syed Hamid Albar said today.

Speaking in general terms, he said no one was above the law and added that action would be taken against those who broke the law, even if it was the police.

“We will not conceal the facts,” he told reporters at his office here.

Syed Hamid said he was not linking his statement, made in general terms, with the death of car theft suspect A. Kugan who had died while in police custody at the Taipan police station in Subang Jaya on Jan 20.

“I am not pinpointing anybody,” the minister stressed.

He explained that police had detained three suspects including Kugan following investigations into 19 cases of vehicle theft and armed robbery.

The minister also asked the people not to politicise the investigation into Kugan’s death, saying it would make the police task more difficult.

“They must talk of the case based on facts and not assumptions,” he said.

Kugan, 22, who was detained on Jan 15 at the Taipan police station on suspicion of being involved in the theft of luxury cars in Sungai Chua, Kajang, had died while being questioned.

Selangor police chief Datuk Khalid Abu Bakar had said a post-mortem found that Kugan had died due to fluid in his lungs but Kugan’s family sought a second post mortem, insisting that Kugan had died of injuries.

Attorney-General Tan Sri Abdul Gani Patail said later that Kugan’s death had been classified as murder. A second post-mortem on Kugan has been done since.

The police are investigating Kugan’s death and the results are expected to be known soon.

Autopsy no. 2 finds external injuries

A second autopsy on suspected car thief Kugan Ananthan has found external injuries caused by blunt force trauma, sources told The Malaysian Insider.

The 22-year-old, who died while in police custody on Jan 20, was said to have died of cardiac arrest following the injuries, the sources said.

Initial findings also revealed Kugan was asthmatic, and his condition had caused phlegm to accumulate in his lungs.

The full report is expected to be issued within days after Universiti Malaya Medical Centre pathologists carried out the autopsy that lasted nearly 10 hours on Sunday following a dispute over earlier findings that he had died of "water in the lungs".

The Attorney-General’s Chambers have classified the case as murder and 11 policemen from the Subang USJ Taipan police station have been reassigned to desk duty pending investigations.

It is understood that closed-circuit-television-cameras (CCTV) were not placed in the police station’s lock-up despite a directive years ago that was intended to prevent claims of police abuse.

Kugan was said to be part of a syndicate involved in stealing luxury cars but his family said he has no criminal record and worked as an insurance claims executive.

Kugan will be cremated at the Puchong Batu 14 crematorium on Wednesday.

Fearing trouble, police have warned his family and friends not to turn the funeral into a protest following unconfirmed reports that a procession with banners and placards are being planned.

The police are now questioning some 21 people, including two deputy ministers, for allegedly barging into a hospital mortuary to view Kugan’s body last week. The family and the two politicians dispute the police and hospital version of events, saying they had a right to see the body.

His death is the latest over the years of suspects, mainly Indians, who had died suddenly in police custody.

Political parties across the divide have asked for an independent probe into his death and others in the past.

His family has also criticised the police for hiding behind a wall of silence over the death.

“The police never informed us that he was arrested and we only heard about it from an anonymous caller,” Kugan’s uncle V. Raviroy told The Malaysian Insider.

The 42-year-old businessman said no matter what Kugan was accused of doing; he did not deserve to die.

“Kugan was only 22, he had his whole life ahead of him, why did he end up dead in the lockup?” he lamented.

Jangan biar rakyat laungkan kata-kata "samseng, pembunuh beruniform"

KUALA LUMPUR, 25 Jan - Setiap kali membaca laporan yang mendakwa pihak polis menyiksa orang kena tahan (OKT) sehingga terbunuh, ahli-ahli PAS semakin teringat peristiwa Memali, kata Ketua Penerangan PAS, Datuk Mahfuz Omar.

"Umpamanya bila kita mendengat kes kematian Kugan Ananthan di Balai Polis Taipan, Subang Jaya, kita semakin teringat bagaimana Asy-Syahid Ustaz Ibrahim Libya dan para pengikutnya yang tidak dibuktikan kesalahan mereka diserang dan dibunuh oleh pihak polis atas arahan para pemimpin Umno.

"Kita juga semakin teringat bagaimana mereka yang ditahan selepas pembunuhan beramai-ramai itu disiksa dengan begitu kejam. Senator Mohamad Yusuf Husin adalah salah seorang yang disiksa dengan begitu teruk dan beliau boleh menceritakannya," kata Ahli Parlimen Pokok Sena itu.

Jumaat lalu, Peguam Negara, Tan Sri Abdul Gani Patail hari ini mengklasifikasikan kes kematian Kugan Ananthan dalam tahanan polis sebagai kes bunuh.

Kugan ditahan di Kajang pada 15 Januari lalu berhubung kes kecurian kereta. Lima hari kemudiannya, dia meninggal dunia ketika disoal siasat di Balai Polis Taipan, Subang Jaya.

Keluarganya tidak berpuas hati dengan kematian Kugan mendakwa dia didera polis kerana ada banyak kesan kecederaan pada tubuhnya walaupun laporan bedah siasat menunjukkan kematiannya adalah akibat paru-paru berair.

Bedah siasat kedua ke atas mayat Kugan dijadualkan dilakukan hari ini di Pusat Perubatan Universiti Malaya.

"Walaupun beliau ditahan berhubung kes kecurian kereta, tetapi apabila Peguam Negara mengklasifikasikan kematian beliau sebagai kes bunuh dan beliau pula berada di dalam lokap polis, Menteri Dalam Negeri bertanggungjawab mengarahkan penyiasatan dipercepatkan dan beliau tidak boleh membiarkan masyarakat terus melaungkan kata-kata pembunuh bergaji, pembunuh beruniform, samseng beruniform dan sebagainya," kata Mahfuz.

Jika benar Kugan dibunuh oleh pihak polis yang menyoalsiasat beliau, katanya, PAS mengutuk sekeras-kerasnya pembunuhan itu.

"Kita juga menuntut kerajaan menubuhkan suruhanjaya siasatan bebas ke atas pembunuhan itu.

"Kita bimbang ada tangan-tangan luar yang mengarahkan supaya Kugan diperlakukan apa sahaja untuk mendapatkan maklumat darinya kerana beliau dilaporkan ditangkap berikutan kecurian kereta-kereta mewah," katanya.

Suruhanjaya tersebut juga hendaklah diberi kuasa untuk menyiasat semua kejadian yang sama dengan kejadian pembunuhan Kugan, kata Mahfuz lagi.

Pada 29 Disember 2003, ketika beliau baru memegang jawatannya sebagai Perdana Menteri, Datuk Seri Abdullah Badawi mengumumkan, kerajaan akan menubuhkan sebuah suruhanjaya diraja bagi mengenal pasti langkah-langkah yang boleh diambil bagi menjadikan PDRM sebagai satu pasukan penguat kuasa undang-undang yang berwibawa dan dihormati.

Suruhanjaya tersebut kemudiannya ditubuhkan menurut Akta Suruhanjaya Siasatan 1950 dan dipengerusikan oleh bekas Ketua Hakim Negara, Tan Sri Mohamed Dzaidin dan 15 anggota yang lain.

Suruhanjaya yang ditubuhkan pada 4 Februari 2004 itu mengemukakan 125 cadangan kepada kerajaan untuk membaiki imej polis.

Salah satu cadangan utama Suruhanjaya tersebut adalah untuk kerajaan mewujudkan IPCMC (Independent Police Complaints and Misconduct Commission) dan tarikh akhir penubuhannya dicadangkan pada 31 Mei 2007.

Cadangan tersebut ditentang hebat oleh pihak polis sendiri dan akhirnya cadangan tersebut tinggal cadangan sahaja.

Selangor police chief: Don’t turn Kugan funeral into a political protest

KUALA LUMPUR, Jan 26 — The Selangor police have warned those attending the funeral of A. Kugan, who died whilst in police custody, not to participate in any illegal gathering or carry banners and posters.

The funeral is scheduled on Wednesday.

Selangor police chief Datuk Khalid Abu Bakar said the funeral should not be politicised or turned into an illegal demonstration as it would disrupt public order and lead to chaos.

He believed that plans were underway by certain groups to turn the occasion into an illegal gathering to protest against alleged police brutally.

Khalid said the police learnt the funeral procession would be organised in such a manner that it would involve certain parts of the city before arriving at an undisclosed burial ground in Selangor.

"Cards and banners are also expected to be carried by members of the procession," he said in a statement here today.

The police chief advised the public not participate in the illegal gathering as the force was not against a normal funeral procession and respected the grieving family. — Bernama
