Условия использования мобильного приложения 1С:Ник

Разработка, назначение и правообладание

1С:Ник - это специальное программное обеспечение, направленное на подготовку к экзамену 1С:Профессионал, получение новостного контента и справочной информации о свидетельствах и сертификатах.

Данное программное обеспечение является собственностью ЧОУ ДПО "1С-Образование".

Разработку, а также сопровождение и обновление данного ПО осуществляет команда разработки 1С:Учебного Центра №1 (ЧОУ ДПО "1С-Образование").

Материалы (вопросы, ответы и пр.) являются интеллектуальной собственностью ООО "1С-Паблишинг".

Условия использования приложения

  • Запрещается передача доступа к своей учетной записи мобильного приложения другому лицу, не являющимся её владельцем.
  • Запрещается передача, копирование и распространение любым способом учебных материалов (вопросов, ответов и пр.) без письменного разрешения фирмы "1С-Паблишинг".

Политика конфиденциальности

  • Мобильное приложение не передаёт конфиденциальную информацию (заполняемую пользователем в приложении) третьим лицам
  • Оплата мобильного тренажёра производится через сервисы компаний Google и Apple в соответствии с правилами взимания средств за доступ к цифровому контенту.

Условия оплаты цифрового контента

  • Разовый платёж - оплата производится единоразово через встроенные сервисы используемой операционной системой.
  • Подписка - оплата подписки производится раз в неделю (списание оплаты производится автоматически). Отмена подписки производится в мобильных приложениях GooglePlay или AppStore, в зависимости от используемой операционной системой на мобильном устройстве.

1. Acknowledgement: This End User License agreement (EULA) is between you and App developer (1C-Publishing LLC, the Application Provider/Licensor,we) only, and not Apple. App developer, not Apple, is solely responsible for the App (Licensed Application) and  the content thereof. Licensed Application is available through the App Store is licensed, not sold, to you.
2. Scope of License: App developer grants you a limited, non-exclusive, non-transferable, revocable license to use the Licensed Application and all of Licensed Application’s content. You may only use the Licensed Application on any Apple-branded Products that you own or control and as permitted by the Apple App Store Terms of Service. Except as provided in the Usage Rules, you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute or sublicense the Licensed Application and, if you sell your Apple Device to a third party, you must remove the Licensed Application from the Apple Device before doing so. You may not copy (except as permitted by this license and the Usage Rules), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, any updates, or any part thereof (except as and only to the extent that any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of any open-sourced components included with the Licensed Application).
3. Maintenance and Support: the Application Provider may provide limited support. Please, to contact us at mobile-edu@1c.ru. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
4. NO WARRANTY: YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION AND ANY SERVICES PERFORMED OR PROVIDED BY THE LICENSED APPLICATION ARE PROVIDED "AS IS" AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND LICENSOR HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE LICENSED APPLICATION AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY LICENSOR OR ITS AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE LICENSED APPLICATION OR SERVICES PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION. TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE LICENSED APPLICATION, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU. In no event shall Licensor’s total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of 1 US dollar ($1.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.
5. Product Claims: App developer doesn’t make any warranties concerning Licensed Application. To the extent you have any claim arising from or relating to your use of Licensed Application, App developer, not Apple, is responsible for addressing any such claims, which may include, but are not limited to (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with Your Licensed Application’s use of the HealthKit and HomeKit frameworks. Nothing in this agreement shall be deemed an admission that you may have such claims. All the claims for the Licensed Application shall go through court in the state of residence of the Licensor.
6. Intellectual Property Rights: In event of any third party claim that the Licensed Application or the End-User’s possession and use of that Licensed Application infringes that third party’s intellectual property rights, Licensed Application Developer, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
7. Legal Compliance: The End-User must represent and warrant that (i) he/she is not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) he/she is not listed on any U.S. Government list of prohibited or restricted parties.

9. Third Party Terms of Agreement: You must comply with applicable third party terms of agreement when using this Application (e.g. your wireless agreement).
10. Tariff Plans Terms. If you decide to use the App (Application), you thereby agree to the tariff plans terms used in the Application.
•    The Application can be downloaded for free. However, some of the functions and/or content of the Application (Premium Section of the Application) are offered by subscription or by fixed, separate one-time fee. You agree to pay any applicable fees (and any related taxes) on App Store as they become due.
•    You authorise App Stores to charge applicable fees to the payment card you provide.  
•    By taking out some certain subscriptions, you agree that each of your subscriptions may be automatically renewed. If you do not cancel your subscription less than 24 hours before the end of the current subscription period, you authorise App Stores to charge you a renewal fee. The auto-renewal period will be the same as the period of your initial subscription, unless other information concerning the Application is provided. The cost of the renewal will not exceed the price of the subscription for the period preceding the renewal, except for specially set prices and discounts, unless we notify you of the change in price prior to your automatic renewal. You must cancel your subscription in accordance with the cancellation procedure provided to you for this particular subscription. We do not refund any fees that may have been charged to your account, and we do not charge prorated fees for canceled subscriptions.
•    We can offer a free trial subscription to the Premium Section of the Application. The free trial period provides access to the Premium Section of the App for a limited period of time in accordance with the initial subscription terms. If you do not cancel your subscription to the Premium Section of the App before the free trial period expires or unless stated otherwise, your access to the Premium Section of the App will be automatically renewed and you will be billed with corresponding fees for using it. This is your responsibility to know when the trial period expires. We reserve the right to restrict your ability to take advantage of multiple free trial periods.
•    Subscriptions purchased from an Application Store are subject to the refund policy of that Application Store. Therefore, we cannot provide a refund, and if you believe you are eligible for a refund, you should contact the support team of this Application Store.
•    You are the one who manages your subscription. Your subscription can be cancelled in accordance with the cancellation procedure.
