The Decree of the Federal Service of the National Guard troops

The President signed a Decree "Issues of the Federal Service of the Russian Federation, National Guard troops."

The full text of the Decree:

In order to ensure public security and public safety, protection of the rights and freedoms of individuals, being guided by Article 80 of the Constitution and pending adoption of the federal law, decree:

1. To establish the Federal Service of the Russian Federation troops National Guard.

2. Convert internal troops of the Ministry of Internal Affairs of the Russian Federation to the troops of the Russian Federation National Guard.

3. To establish that:

a) the troops of the Russian Federation National Guard are included in the structure of the Federal Service of the Russian Federation troops National Guard;

b) The Federal Service of troops of the National Guard of the Russian Federation is a federal body of executive authority responsible for the development and implementation of the state policy and normative legal regulation in the sphere of activity of troops Russian Federation National Guard in arms trafficking, in the field of private security and in private security;

c) the Federal Service of the Russian Federation, National Guard troops headed by the Director of the Federal Service of the Russian Federation troops National Guard - commander in chief of the troops of the National Guard of the Russian Federation, which manages the troops of the National Guard of the Russian Federation;

g) The Director of the Federal Service of troops of the National Guard of the Russian Federation - Chief of the troops of Russian Federation National Guard uses in dealing with the organization of the Federal service for military service in the armed forces of the Russian Federation and National Guard service in the Federal service of the rights and powers laid down for heads of federal executive authorities, which provide for military service (service).

4. Turn on the structure of the Federal Service of the Russian Federation troops National Guard:

a) The bodies of internal affairs and units of the Ministry of the Russian Federation by the federal state control (supervision) over observance of the Russian legislation in the field of arms trafficking in the field of private security activities, as well as security services, including the Center for Special Purpose private security service of the Ministry of the Interior Affairs of the Russian Federation;

b) special rapid reaction units of territorial bodies of the Ministry of Internal Affairs of the Russian Federation;

c) mobile teams of special purpose of territorial bodies of the Ministry of Internal Affairs of the Russian Federation;

d) Special Operations Center Rapid Reaction Force and Aviation Ministry of Internal Affairs of the Russian Federation and aviation units of the Ministry of Internal Affairs of the Russian Federation.

5. Transfer the Federal State Unitary Enterprise "Protection" of the Ministry of Internal Affairs of the Russian Federation under the jurisdiction of the Federal Service of the Russian Federation troops National Guard.

6. To entrust the Federal Service of the Russian Federation, National Guard troops the following main objectives:

a) participate jointly with the Interior of the Russian Federation in the protection of public order, public security and the state of emergency;

b) participation in the fight against terrorism and to ensure that the legal regime of counter-terrorist operations;

c) participation in the fight against extremism;

g) participation in the territorial defense of the Russian Federation;

d) protection of important state facilities and special cargoes in accordance with the list approved by the RF Government;

e) assist border authorities of the Federal Security Service in protecting the state border of the Russian Federation;

g) implementation of the federal state control (supervision) over observance of the Russian legislation in the field of arms trafficking in the field of private security activities, as well as the implementation of the private security service.

7. Allow to have troops in the Federal Service of the Russian Federation of the National Guard six Deputy Directors, including the Deputy Director of the Federal Service of the National Guard troops of the Russian Federation - Chief of the troops of the National Guard of the Russian Federation; Chief of Staff of the National Guard troops of the Russian Federation - First Deputy Director of the Federal Service of the National Guard troops of the Russian Federation - Chief of the troops of the National Guard of the Russian Federation; State Secretary - Deputy Director of the Federal Service of the National Guard troops of the Russian Federation - Chief of the troops of the National Guard of the Russian Federation.

8. The Director of the Federal Service of the Russian Federation troops National Guard - commander in chief of the troops of the National Guard of the Russian Federation, his first deputy and deputies are equal in status, size of remuneration, conditions of Social Security and Medicare, respectively, to the Federal Minister, his first deputy and deputies.

9. To establish that:

a) persons who have special police ranks, he served in the administration and departments, special detachments, detachments of mobile special purpose, Special Operations Center and aviation departments named in paragraph 4 of this Decree, transferred to the Federal Service of troops Russian Federation National Guard, saved previously assigned special ranks;

b) before the entry into force of the federal law on persons with special titles, translated to the Federal Service of the Russian Federation troops National Guard, subject to the provisions of the federal law of 19 July 2011 ? 247-FZ "On the social guarantees of officers of Internal Affairs of Russian Federation and amendments to certain legislative acts of the Russian Federation "and dated November 30, 2011 ? 342-FZ" on service in bodies of internal affairs of the Russian Federation and the introduction of amendments to certain legislative acts of the Russian Federation ";

c) special units, detachments mobile special purpose, Special Operations Center and aviation units, named in subparagraphs "b" - "d" of paragraph 4 of this Decree, are under the operational control of the Minister of Internal Affairs of the Russian Federation and the respective heads of the territorial bodies of the Ministry of Internal Affairs of the Russian Federation. Procedure operational control established by the Minister of Internal Affairs of the Russian Federation in coordination with the Director of the Federal Service of the National Guard troops of the Russian Federation - the commander of the troops of the National Guard of the Russian Federation. Before the establishment of the said order of aviation equipment of aircraft units used for transportation of employees and property law-enforcement bodies of the Russian Federation by the decision of the Minister of Internal Affairs of the Russian Federation.

10. Transfer of the Federal service of the troops of the National Guard of the Russian Federation, the number of military and civilian personnel of the Internal Troops of the Ministry of Internal Affairs of the Russian Federation, as well as bodies, units, special units, mobile units of special designation, the Centre and special purpose aviation units named in paragraph 4 of this Decree.

11. The Federal Service of the National Guard troops of the Russian Federation is the legal successor of the Ministry of Internal Affairs of the Russian Federation in respect of transferred her management bodies, associations, formations, military units, military educational institutions of higher education and other organizations of the internal troops of the Ministry of Internal Affairs of the Russian Federation, as well as on governments, departments, special units, mobile units of special designation, the Centre and special purpose aviation units named in paragraph 4 of this Decree, including for obligations arising as a result of the execution of judgments.

12. Positions governments, associations, formations, military units, military educational institutions of higher education and other organizations of Internal Troops of the Ministry of Internal Affairs of the Russian Federation, as well as governments, departments, special units, mobile units of special designation, the Centre for a special purpose and aviation divisions named in paragraph 4 of this Decree, buildings, other immovable and movable property from the date of entry into force of this Decree are attached to the operational management of the Federal service of the Russian Federation troops national Guard.

13. Persons performing military service in the Russian Federation and National Guard troops serving in the national army of the Federal Service of the Russian Federation Guard and civilian personnel of troops of the Russian Federation of the National Guard continued to perform military service (service pass, run) on replaceable (held) positions without revalidation and reassignments until the appropriate organizational and staff measures. Contracts for military service (service) are within the terms on which they were made.

14. To establish that:

a) prior to the entry into force of the federal law activities of troops Russian Federation National Guard, the Federal Service of troops Russian Federation National Guard, as well as persons performing military service in the Army National Guard of the Russian Federation and the service of the Federal Service of troops Russian Federation National Guard, carried out in accordance with the provisions of the federal laws that define the tasks of internal troops of the Ministry of internal Affairs of the Russian Federation and the powers of the police, the rights of servicemen of the Interior troops of the Ministry of internal Affairs of the Russian Federation and the police, as well as the order of the federal state control (supervision) over observance of the Russian legislation in the sphere of circulation weapons and in private security activities and procedures of private security;

b) before the entry into force of normative legal acts of the Russian Federation, regulating the activity of the troops of the National Guard of the Russian Federation and the Federal Service of troops Russian Federation National Guard, the normative legal acts of the Russian Federation President, the Russian Federation, federal executive authorities and other federal government agencies, regulating the activities of the internal troops of the Ministry of internal Affairs of the Russian Federation and the police, as well as determining the order of the federal state control (supervision) over observance of the Russian legislation in the field of arms trafficking in the field of private security and procedures for private security;

c) persons having special ranks, serving in special units, detachments of mobile special purpose, Special Operations Center and aviation departments named in subparagraphs "b" - "d" of paragraph 4 of this Decree, adopted in 2018 for military service in the army national Guard of the Russian Federation in the established procedure with assignment of the respective ranks.

15. Persons who have special ranks, serving in the internal affairs of the Russian Federation shall be transferred to the Federal Service of the Russian Federation with the consent of the National Guard troops.

16. Save for the persons transferred to the Federal Service of the National Guard troops of the Russian Federation of the law-enforcement bodies of the Russian Federation, held on the account as needing residential area, eligible for inclusion in the waiting list for a new post with a statement of the date on account of the previous place service for the dwelling or of a lump sum subsidy for its purchase.

17. Save for the persons transferred to the Federal Service of the National Guard troops of the Russian Federation of the law-enforcement bodies of the Russian Federation, to the provision of premises for the social contract of employment or ownership right to the premises occupied by them specialized housing, which arose prior to the date of entry into force this Decree.

18. To carry out medical care and sanatorium treatment of persons performing military service in the Army National Guard of the Russian Federation and the service of the Federal Service of the Russian Federation troops National Guard and their families in medical institutions of the Ministry of the Interior (in case of absence the place of military service (service) medical institutions of the Russian Federation troops of the national Guard) at the expense of budgetary allocations provided for in the federal budget of the Federal service of the Russian Federation troops of the national Guard for this purpose.

19. Allow Troops of the National Guard of the Russian Federation, the Federal Service of the Russian Federation troops National Guard, as well as persons performing military service in the Army National Guard of the Russian Federation and the service of the Federal Service of the Russian Federation troops National Guard, the use of identification cards, letterheads, seals and stamps Ministry of internal Affairs of the Russian Federation until January 1, 2017.

20. Allow persons performing military service in the Army National Guard of the Russian Federation and the service of the Federal Service of the Russian Federation troops National Guard, wearing uniforms of servicemen of internal troops of the Ministry of Internal Affairs of the Russian Federation and the employees of the internal affairs of the Russian Federation to the approval of the Russian Federation Government of the respective samples uniforms and timing to ensure the appropriate clothing and equipment (uniforms).

21. 22. The Government of the Russian Federation:

a) in the prescribed manner to reallocate budgetary allocations of the federal budget in accordance with the present Decree;

b) to make proposals on the number of troops of the Federal Service of the Russian Federation, the National Guard, including the troops of the National Guard of the Russian Federation;

c) submit to the established procedure a draft regulation of the Federal Service of the Russian Federation troops National Guard;

d) bring their acts into conformity with the present Decree;

d) submit proposals to bring the acts of the President of the Russian Federation in conformity with the present Decree;

e) save for persons performing military service in the National Guard troops of the Russian Federation and the service of the Federal Service of troops Russian Federation National Guard, as well as their family members, health care and spa treatment in the medical institutions of the Ministry of Internal Affairs of the Russian Federation, where such security and treatment carried out previously;

g) to provide a solution of financial, logistical and other matters related to the implementation of this Decree.

23. This Decree shall enter into force on the day of its signing.
