Colonel Patton called my attention to the gallant bearing of Major Dearing, as he galloped, flag in hand, from gun to gun of his battalion and suggested that it would be safer for us to close up on the artillery; but I told him he must not think of moving without orders and, besides, it was evident that the enemy's fire was rapidly abating, and that the storm would soon be over. The words were barely spoken before it came again; our turn now. I thought at first that it was my adjutant, John Stewart, as a handful of earth mixed with blood and brains struck my shoulder; but they were two poor fellows belonging to Company D (one of them, I remember, had a flaming red head), and another, as we believed, mortally hurt, Sergeant-Major Davy Johnston, of the Seventh, author of the book I have quoted. Drowned. --John Stewart, a corporal in the marine corps of the U. S. sloop Hartford, and belonging to Philadelphia, went on shore at Shanghai, on the 4th of July, and when returning to the ship fell overboard and was drowned.
Hustings Court. --This Court met yesterday, at 11 o'clock, and disposed of a large amount of business. We notice the criminal cases disposed of: John Stewart was fined $10 and costs for permitting his slave, George Mosby, to go at large. Mary Shay, charged with feloniously stealing $30 from Patrick Reynolds, on the 14th November, was examined and remanded for final trial before Judge Lyons. Peter Scott, a free negro, charged with stealing a gold watch from Dr. John R. Brooks, on the 18th of October, was tried and acquitted. Samuel H. Jefford, charged with feloniously stealing $30 from Martin L. Covington, on the 15th of May, having waived an examination, is to be tried before Judge Lyons on Monday next. Cornelius, slave to Wm. Tally, charged with feloniously cutting and stabbing Ephraim, slave to Nicholas Lipscomb, on the 29th of November, was found guilty and ordered thirty-nine stripes. P. J. James Hamilton, charged with having up place to stay, and with belonging to the 13th Louisiana regiment, which latter is certainly a singular and significant accusation, was turned over to the care of Gen. Winder. Armstrong McGuire, lately turned out of the Penitentiary was arraigned for drunkenness and trespassing on James Cary, and was allowed to go at, large upon condition that he would leave the city forthwith. Conway, a slave, was ordered 15 lashes for throwing stones. John Stewart's case was again continued, and he remanded to jail. Lucien Q. Landidm gave bail for his appearance before the Hustings Court to answer the charge of unlawfully stabbing and wounding Mr. Roach. George Sinclair, an Englishman and a British subject, who claims to have joined our army, was brought up charged with assaulting and beating some man named "Bob."
