th Georgia regiment, then stationed in Florida. He opened the fight at Ocean Pond (Olustee), Fla., and upon the death in that battle of his brother, P. A. Waller, first lieutenant of same company, he was promoted to fill the vacancy. He served with the Sixty-fourth Georgia to the close of the war. For distinguished valor and skill in the battle of the Crater at Petersburg he was promoted to captain by President Davis through the secretary of war, James A. Seddon, to rank as such from December 21, 1864, and was assigned to command of Company G of the Sixty-fourth. He surrendered at Appomattox Court House, being at the time in command of his regiment, the colonel having been killed, the division commander being General Mahone and General Gordon his corps commander. He participated in the following battles: First Manassas, Maryland Heights, Sharpsburg, Fredericksburg, First and Second Chancellorsville, Brandy Station, Gettysburg, Chickamauga, Ocean Pond, Crater, Deep Bottom, Weldon R
