1.1. We are committed to protecting and respecting your privacy. This Privacy Policy («Policy»)
describes how we treat information that you provide to us or that we collect about you.
For the purpose of the General Data Protection Regulation 2016/679 and any implementing
legislation (the "GDPR"), Pixeland with registered address at Estonia, Harjumaa,
Tallinn, Pae tn 25-47, 11414 will be the data controller responsible for any personal data we
process.
In this Policy, the following definitions are used:
«Services» refers to our Apps, Websites and any related services or properties we control;
«Applications/Apps» refers to games, applications and other products produced by us on any
and all platforms;
«Websites» refers to websites and other online properties we control;
«Personal Data» is used when referring to personal data that relates to you as an identified or
identifiable individual;
«Face data» - information related to human faces (e.g., face mesh data, facial map data,
face modeling data, facial coordinates or facial landmark data, including data from
an uploaded photo) that is obtained from a user’s device and/or through the use of the Apple
Software - the TrueDepth API.
«Anonymous data» does not include data where the identity has been removed;
«User, consumer» is any third party that use our Services.
1.2. By personal data, we refer to data that relates to you as an identified or identifiable person.
Personal data include your name, your address, your telephone number, your email address,
your age, your gender and your game preferences. Anonymous information which we are not
in a position to relate to you, does not qualify as personal data.
We may collect personal data as well as other information when you use any of our services or
applications provided on a mobile platform (for example iOS and Android) (together referred
to as the «Services»).
1.3. Please read this Policy carefully. If you wish to use our Services, you will need to accept
our Terms of Use and this Policy. By accepting this Policy, you signify your consent to the
collection and other processing of your personal data in accordance with and for the purposes
set out in this Policy.
1.4. We respect your right to privacy and will only process personal data and other information
you provide to us or we collect about you in accordance with applicable privacy and personal
data protection laws.
1.5. We have the right to update this Policy from time to time so please be sure to check
regularly. We will notify you of any material changes by posting the new Policy on the primary
access points to the Services or as otherwise required by applicable law.
1.6. Before you start using the Apps, you shall read our Policy and Terms of Use and press the
button “Confirm”. By pressing the button “Confirm”, you hereby freely gives, specific,
informed and unambiguous consent to the processing of the personal data relating to him or her
and mentioned above for the purposes of personal data processing indicated hereto in
accordance with this Policy and the provisions of General Data Protection Regulation 2016/679
(GDPR).
2. Personal data (types, purposes, legal basis)
2.1. When you use our Services, we can collect, use, receive, process, transfer and share some
of your Personal Data for different legitimate purposes. You will find below explanations
regarding what Personal Data we may collect, the reasons why we may collect this data and the
legal bases relied on in each case. Please, be notice that the types of information that we may
collect depend on how you use the Services and interact with us.

2.2. We may anonymize your Personal Data (so that it can no longer be associated with you)
for research or statistical purposes. In such cases we may use anonymous information without
further notice to you since such information is not considered as Personal Data and cannot be
connected with you.
2.3. We generally process your Personal data on the following legal bases:
2.3.1. Contract. You have entered a contract with us and we need to use some of your personal
data to provide services you have requested or take steps that you request prior to providing
services. For example, we cannot create an account for you if you do not provide required
information like your email address. If you do not provide information indicated as required or
mandatory within our service, it will not be available to you.
2.3.2. Legal obligations. We may have to process or share your Personal data to comply with
legal obligations, such as to comply with a subpoena or legal process.
2.3.3. Legitimate interests. We process your Personal data for purposes that constitute our
legitimate interests, such as fraud prevention and safety; protecting our, your or others’ property
rights; exercising or defending legal claims; investigating violations of and enforcing our Terms
of Use; analyzing and improving our services; and marketing and advertising.
2.3.4. Consent. In some cases, we may process your Personal data based on your consent, such
as where we request access to data on your mobile device through the prompts in your device’s
operating system. You have the right to withdraw your consent anytime in the manner indicated
at the time consent is requested with no impact on the validity and lawfulness of collection or
processing based on the consent made before its withdrawal.
3. Face data
3.1 Use of TrueDepth API
We utilize the TrueDepth API provided by Apple Inc. for specific features within our services.
This technology enables access to facial recognition capabilities on compatible devices. Our
practices concerning facial data usage are as follows:
a) Facial Data Collection:
When you engage with features or functionalities based on the TrueDepth API in our services,
such as facial recognition for authentication or personalized experiences, the TrueDepth camera
on your device may collect facial data. This includes facial landmarks, depth maps, and other
facial attributes.
b) Use of Facial Data:
The facial data collected via the TrueDepth API is used exclusively for the functionalities
provided within our application, such as authentication and personalized user experiences. This
data helps improve the accuracy and reliability of these features.
c) Storage and Processing:
We do not store or transfer facial data collected through the TrueDepth API to our servers or
third parties. The facial data processed by our services using the TrueDepth API is securely
stored on your device and is utilized solely for the intended functionalities within the
application.
d) Disclosure and Sharing of Facial Data:
We do not share personal data obtained through the TrueDepth API with third parties, including
advertising networks, partners, or service providers. There is no disclosure of facial data to any
external entities.
e) Retention of Facial Data:
Facial data obtained through the TrueDepth API is retained only for as long as necessary to
provide the intended functionalities within the application. Since this data is stored on your
device and not transferred to our servers, you have control over its retention through your device
settings.
f) User Consent:
We will seek your explicit consent before accessing or utilizing the TrueDepth API for any
features related to the collection or processing of facial data.
g) Data Security:
We implement appropriate measures to safeguard the security and privacy of any facial data
accessed or processed via the TrueDepth API. However, please note that no transmission or
storage method is entirely secure, and we cannot guarantee the absolute security of facial data.
h) User Control:
You have the option to enable or disable features or functionalities of our services that depend
on the TrueDepth API through your device settings.
3.2 Apple's Policies
Please note that the use of the TrueDepth API and associated facial data is subject to Apple's
privacy policy and terms of use. We encourage you to review Apple's privacy policy and terms
of use for more information.
4. Children's Privacy
4.1. Pixeland OÜ is committed to protecting the privacy and personal information of children
under the age of 13 in accordance with the Children's Online Privacy Protection Act (COPPA).
This Privacy outlines our practices regarding the collection, use, and disclosure of children's
personal information. By using our services, platforms, websites, or applications, you
acknowledge that you have read and understood this Privacy.
4.2. We do not intentionally collect personal information from children, except for permanent
identifiers. If we learn that we have collected personal information other than permanent
identifiers from a child under the age of 13, we will take all reasonable steps to delete the
information as soon as possible. If you become aware that your child has provided us with
personal information without your consent, contact us at support@pxlnd.com
4.3. The only personal information we collect from all users, including those who identify
themselves as under the age of 13, for the purpose of providing our services are persistent
identifiers (such as device ID, IDFA, IDFV, advertising ID, publisher-provided ID, IP address,
OS, precise location). Such persistent identifiers are used and shared with third parties solely
to support internal operations related to contextual advertising (including frequency limitation),
to authenticate users or personalize content on Apps, to maintain or analyze the performance of
Apps, to personalize App content (such as sending push notifications), to conduct network
communications to protect the security or integrity of the user or App, to ensure compliance.
4.4. The personal information collected from сhildren under the age of 13 is used solely for the
purpose of providing and improving our services. We do not disclose children's personal
information to third parties for marketing or promotional purposes without obtaining verifiable
parental consent. The information collected is treated with the utmost care and is safeguarded
through appropriate security measures.
4.5. Parents or legal guardians have the right to review the personal information collected from
their children, request its deletion, and refuse further collection or use of their child's
information. If a parent wishes to exercise these rights, they can contact us using the information
provided at the end of this privacy policy. We will promptly respond to all valid requests from
parents to ensure the privacy and protection of their children's personal information.
4.6. We implement appropriate physical, technical, and administrative safeguards to protect
children's personal information from unauthorized access, disclosure, alteration, or destruction.
We regularly review and update our security measures to ensure their effectiveness and
compliance with industry standards. Additionally, we train our employees on the importance
of protecting children's personal information and maintaining their privacy.
4.7. Our services may include links to third-party websites or services that are not owned or
controlled by us. We do not knowingly direct children under the age of 13 to third-party services
that may collect their personal information without obtaining verifiable parental consent.
However, we encourage parents to review the privacy policies of any third-party services their
children may access through our platform.
4.8. As our services evolve, we may update our privacy policy to ensure ongoing compliance
with COPPA and other applicable laws and regulations. We will provide notice of any material
changes to our privacy practices regarding children's personal information, and we will obtain
verifiable parental consent for any new purposes of data collection, use, or disclosure that may
require consent under COPPA.
5. Protecting Personal Information under the California Consumer Privacy Act (CCPA)
5.1. This chapter applies to all individuals who reside in California and whose personal
information is collected, used, or disclosed by Pixeland . We recognize the rights of
California consumers under the CCPA and take necessary steps to respect and fulfill those
rights.
5.2. Under the CCPA, Pixeland may collect the following categories of personal
information:
5.2.1. Identifiers (e.g., name, address, email address, phone number);
5.2.2. Personal records (e.g., Social Security number, driver's license number);
5.2.3. Commercial information (e.g., purchase history, transaction details);
5.2.4. Internet or other electronic network activity information (e.g., browsing history,
interactions with our website);
5.2.5. Geolocation data;
5.2.6. Audio, electronic, visual, or similar information (e.g., customer support recordings);
5.2.7. Inferences drawn from the above information (e.g., preferences, characteristics);
5.3. Pixeland OÜ collects and uses personal information for the following purposes:
5.3.1. Providing and improving our products and services;
5.3.2. Personalizing user experiences;
5.3.3. Processing transactions and orders;
5.3.4. Responding to customer inquiries and support requests;
5.3.5. Analyzing and understanding usage trends;

5.4. Pixeland may disclose personal information to the following categories of third parties:
5.4.1. Service providers: We may engage third-party service providers who assist us in fulfilling
our business operations, such as payment processors and customer support platforms.
5.4.2. Legal and regulatory entities: We may share personal information as required by law or
to respond to legal requests, subpoenas, or court orders.
5.4.3. Affiliated companies: We may share personal information with our affiliated companies,
subsidiaries, or parent companies, but only to the extent permitted by applicable laws.
5.5. Under the CCPA, California consumers have the following rights:
5.5.1. Right to know: Consumers have the right to request information about the categories and
specific pieces of personal information collected, the sources from which it was collected, the
purposes for collection, and the categories of third parties with whom it is shared.
5.5.2. Right to deletion: Consumers have the right to request the deletion of their personal
information, subject to certain exceptions.
5.5.3. Right to opt-out: Consumers have the right to opt-out of the sale of their personal
information to third parties.
5.5.4. Right to non-discrimination: Consumers have the right to exercise their CCPA rights
without facing discriminatory treatment.
5.6. To exercise their rights under the CCPA, California consumers may submit a verifiable
request through the methods provided by Pixeland OÜ. We will verify the requestor's identity
and process the request in accordance with applicable laws.
5.7. Pixeland maintains reasonable security measures to protect personal information from
unauthorized access, use, or disclosure. These measures include administrative, technical, and
physical safeguards to ensure the confidentiality, integrity, and availability of personal
information.
6. How we use your information
6.1. Purpose of this Policy is fulfillment of the provisions of the Terms of Service (“Contract”)
concluded between the User and Pixeland OÜ. We collect user’s Personal data when user starts
using our Services. For example, we may use the Personal Data in the following ways:
6.1.1. To provide User Service. Our main aim is to perform our contractual obligation towards
User and make our Service available to User. We use information that you submit and
information that is processed automatically to provide you with all requested services.
6.1.2. Account setup and administration: We use Registration information and information
about your device to set up and administer your account, provide technical and customer
support and training, verify your identity, and send important account, subscription and Service
information.
6.1.3. Personalization: We use Personal Data to personalize your experience with our Services.
Some of our Services will ask you to share your geolocation so we can customize your
experience and increase the accuracy of the Service. If you agree to share your geolocation with
us, you will be able to turn it off at any time by going to the privacy settings on your mobile
device or online. For example, we may ask for age verification if we have reasonable doubts
regarding your age.
6.1.4. Providing you with interest-based (behavioural) advertising or other targeted content. We
may use information that is processed automatically for marketing purposes (to show ads that
may be of interest to you based on your preferences). We provide personalized content and
information to you, which can include online ads or other forms of marketing.
6.1.5. To communicate with you. We use the information we have to communicate with you
through newsletters, i.e. to send you marketing notifications, receive your feedback about our
App experience, and let you know about our policies and terms. We also use your information
to respond to you when you contact us.
6.1.6. Research and development: We use Personal Data for internal research and development
purposes and to improve and test the features and functions of our Services. We use information
that is processed automatically to better understand user behaviour and trends, detect potential
outages and technical issues, to operate, protect, improve, and optimize our App.
6.1.7. Legal obligations: We may be required to use and retain Personal Data for legal and
compliance reasons, such as the prevention, detection, or investigation of a crime; loss
prevention; or fraud.
6.1.8. Send you push notifications, related information, including confirmations and reminders
(if you choose to allow that function) user can choose to stop disable these at any time, by
opting out or changing your browser or device settings.
6.2. We may use Automatically Collected information and Cookies information to maintain
and improve our Services, including to do the following things: (a) automatically update the
applications on your system; (b) remember your information so that you will not have to re-
enter it during your visit or the next time you access our Services; (c) provide customized third-
party advertisements, content and information, unless it will include instructions on how to opt
out of receiving these advertisements, content and information in the future; (d)
monitor the effectiveness of third-party marketing campaigns; (e) monitor aggregate site usage
metrics such as total number of visitors and pages accessed.
7. Cookies
7.1. Cookies are files with small amount of data that is commonly used an anonymous unique
identifier. These are sent to your browser from the website that you visit and are stored on your
device internal memory.
7.2. This Service does not use these “cookies” explicitly. However, the App may use third party
code and libraries that use “cookies” to collection information and to improve their services.
You have the option to either accept or refuse these cookies and know when a cookie is being
sent to your device. If you choose to refuse our cookies, you may not be able to use some
portions of this Service.
8. Retention of Data
8.1. We keep most of your Personal Data gathered and processed for the purposes described in
this Policy for as long as you continue to use our Services. We will retain and use your Personal
Data to the extent necessary to comply with our legal obligations. We will also retain Account
Data for internal analysis purposes. Account Data is generally retained for a shorter period of
time, except when this data is used to improve the functionality of our Services, or we are
legally obligated to retain this data for longer time periods.
8.2. We will delete your Personal Data after 14 months of inactivity in your use of our Services.
Once we have deleted your Personal Data, you will not be able to exercise the right to access,
the right to erasure, the right to rectification or the right to data portability.
9. Your rights
9.1. We attach great importance to user’s privacy and would like to explain your data protection
rights.
9.1.1. The right to withdrawal. It’s important to remember that if we process your data based
on your consent, you have the right to withdraw your consent at any time. The withdrawal of
consent shall not affect the lawfulness of processing based on consent before its withdrawal.
Withdrawal is made by sending an e-mail to the address support@pxlnd.com with the topic
«Consent withdrawal» or in the Settings menu of the application.
9.1.2. The right to know what Personal Data we hold, how and why we handle your Personal
Data. You can ask us for a copy of your Personal Data. If you would like to exercise your right
of access, please contact us as described below and let us know what information in particular
you would like to receive.
9.1.3. The right to opt-out of direct or target interest advertising on mobile applications by
checking the privacy settings on your device settings menu. Please note that even if you use
your right to opt-out it you will still receive advertising, but not direct or target interest. On
Apple you can opt-out this by going to Settings > Privacy > Advertising and turning on “Limit
Ad Tracking”. On Android you can opt-out by going to Settings > Google services > Ads and
turning on choosing “Opt out of Ads Personalization”.
9.1.4. The right to request an update or correction (rectify) to any of your Personal Data which
is out of date, incomplete or incorrect (according to Article 16 of the GDPR). In certain specific
circumstances you have the right to ask us to delete your Personal Data which we are holding
about you.
9.1.5. The right to object. You have the right to object to ours processing of your personal data,
under certain conditions.
9.1.6. The right to delete your personal data. (Right to be forgotten).
9.1.7. The right to portability of your personal data. In some circumstances, you may have the
right to request that data which you have provided to us is provided to you, so you can transfer
this to another data controller.
9.1.8. The right to restrict processing of your personal data under the conditions set out in
Article 18 of the GDPR or any other applicable laws in your country of residence.
9.1.9. The right to complain to a data protection authority about our collection and use of your

9.1.10. The right to opt-out of direct or target interest advertising on mobile applications by
checking the privacy settings on your device settings menu. Please note that even if you use
your right to opt-out it you will still receive advertising, but not direct or target interest. On
Apple you can opt-out this by going to Settings > Privacy > Advertising and turning on “Limit
Ad Tracking”. On Android you can opt-out by going to Settings > Google services > Ads and
turning on choosing “Opt out of Ads Personalization”.
9.1.11. The right to request access to the personal information we collect from you, change that
information, or delete it in some circumstances. You have the right to request us for copies of
your personal data. To request to review, update, or delete your personal information, please
submit a request. We will respond to your request within 30 business days. The User is
empowered to request one copy of the personal data undergoing processing free of charge. Any
additional copies are provided on a reimbursement basis.
9.2. You may send the request aimed at exercising your rights provided herein to our email or
to our business address: support@pxlnd.com, Estonia, Harjumaa, Tallinn. If you make a request,
we have one month to respond to you.
10. Sharing your information
10.1. We will not share your personal data with anyone else unless in the following limited
circumstances:
10.1.1. To the extent that we are required to do so by applicable law, by a governmental body
or by a law enforcement agency, or for crime prevention purposes.
10.1.2. Where necessary to enforce Terms of Use in respect of any of the Services, to provide
you with Services you request from us, to protect the safety of our users and third parties, to
protect our rights and property and the rights and property of other users and third parties, or in
other cases if we believe in good faith that disclosure is required by law.
10.1.3. Where necessary to provide you with Services you request from us, we may share your
personal data with third parties who provide services to us (please see list of partners in Annex
A).
10.2. We may share anonymous information, i.e. information which does not directly or
indirectly disclose your identity, and aggregated information (meaning information about
groups and categories of users, including game statistics and behaviour, but which does not
identify and that cannot reasonably be used to identify any individual user) with our advertising
partners. We may also allow our advertisers to collect anonymous information and aggregated
information within the Services and they may then share that information with us. Our
advertisers may collect this information through the use of tracking technologies like cookies
and web beacons. This enables our advertisers to develop and deliver targeted advertising in
the Services of third parties, so that they can try to serve you with advertisements for products
and services that are most likely to be of interest to you. Advertisers will also use this
information to monitor, improve, or modify their operations.
11. Security
11.1. We take reasonable precautions to prevent the loss, misuse or alteration of your Personal
data. Our employees, contractors and agents may be given access to your personal data which
we collect, but their use shall be limited to the performance of their duties in relation to
facilitating your use of the Services. Our employees, contractors and agents who have access
to your personal data are required to keep that data confidential and are not permitted to use it
for any purposes other than those listed above or to deal with requests which you submit to us.
11.2. We shall make our best efforts to get all reasonable technical, administrative and physical
security measures to protect the security of your data.
12. Third party sites
12.1. The Services may contain links to other websites operated and services provided by third
parties, including those retailers you enter into a transaction with. Please note that this Policy
applies only to the personal data that we collect through the Services and we cannot be
responsible for personal data that third parties may collect, store and use through their websites
or their services. You should always read the privacy policy of each website you visit carefully.
13. International Transfer
13.1. We may transfer information that we collect about you to affiliated entities, or to other
third parties across borders and from your country or jurisdiction to other countries or
jurisdictions around the world. We only transfer Personal Data to entities in third countries that
have provided appropriate safeguards to ensure that their level of data protection is in agreement
with this Policy and applicable law.
14. Changes to this Policy
14.1. This Policy may change from time to time, and we encourage you to review it periodically.
Your continued use of our Services signifies your acceptance of changes to this Policy. In some
cases, we may notify you of changes to this Privacy Policy with a prominent notice on our
Services, before the changes become effective and update the "effective date" at the top of this
Privacy.
