Draft notification dated May 2, 2023 was released by the 𝐌𝐢𝐧𝐢𝐬𝐭𝐫𝐲 𝐨𝐟 𝐄𝐧𝐯𝐢𝐫𝐨𝐧𝐦𝐞𝐧𝐭, 𝐅𝐨𝐫𝐞𝐬𝐭 𝐚𝐧𝐝 𝐂𝐥𝐢𝐦𝐚𝐭𝐞 𝐂𝐡𝐚𝐧𝐠𝐞, regarding the Extended Producer Responsibility (EPR) for Used Oil. After considering the suggestions and objections released, the Ministry has now introduced rules, 𝐇𝐚𝐳𝐚𝐫𝐝𝐨𝐮𝐬 𝐚𝐧𝐝 𝐎𝐭𝐡𝐞𝐫 𝐖𝐚𝐬𝐭𝐞𝐬 (𝐌𝐚𝐧𝐚𝐠𝐞𝐦𝐞𝐧𝐭 𝐚𝐧𝐝 𝐓𝐫𝐚𝐧𝐬𝐛𝐨𝐮𝐧𝐝𝐚𝐫𝐲 𝐌𝐨𝐯𝐞𝐦𝐞𝐧𝐭) 𝐒𝐞𝐜𝐨𝐧𝐝 𝐀𝐦𝐞𝐧𝐝𝐦𝐞𝐧𝐭 𝐑𝐮𝐥𝐞𝐬, 𝟐𝟎𝟐𝟑, through Notification dated 18th September 2023, which will be effective from April 1, 2024.
These rules introduce a chapter titled '𝐄𝐱𝐭𝐞𝐧𝐝𝐞𝐝 𝐏𝐫𝐨𝐝𝐮𝐜𝐞𝐫 𝐑𝐞𝐬𝐩𝐨𝐧𝐬𝐢𝐛𝐢𝐥𝐢𝐭𝐲 𝐟𝐨𝐫 𝐔𝐬𝐞𝐝 𝐎𝐢𝐥', which outlines key definitions and concepts related to environmentally sound management of used oil, Key provisions within this chapter include mandatory registration for entities involved in the production of lubrication or base oil, collection, recycling, and import of used oil. It emphasizes that entities must fulfil their EPR by recycling used oil through registered recyclers to ensure environmentally sound management. The rules also outline penalties for providing false information during registration and levy charges based on the volume of used oil handled.
Furthermore, the chapter specifies the modes for managing used oil, with a priority on producing re-refined base oil or lubrication oil and energy recovery. Producers and used oil importers are obligated to fulfil their extended producer responsibility as per the provided targets, and they may seek assistance from third-party organizations, but the ultimate responsibility lies with the producer.
