2023 saw the second highest ever caseload at the Singapore International Arbitration Centre, plus the second highest overall value (USD11.9 bn). Parties from 66 different legal jurisdictions had their cases decided by arbitrators from 38 different jurisdictions. All very impressive! I firmly believe that arbitration is the way to go in terms of alternative dispute settlements for businesses in China. Swiftness, confidentiality, and business acumen of arbitrators are three main advantages often cited as the reasons of the expansion of arbitral awards in Chinese commercial litigation. To reflect these, China International Economic and Trade Arbitration Commission (CIETAC) has released a brand-new set of Arbitration rules, that came into force this year. This is the 10th version since CIETAC’s establishment, showing the adaptability of arbitration rules to the evolving practices, experience, and business environment. While updating the previous provisions, the 2024 rules are embodying the latest developments in terms of international arbitration, such as early dismissal or the rise of digitalisation, to name a few. After a busy June travelling across various events, it’s time to return with some insights from London International Disputes Week (LIDW). Alongside my colleagues Vilija Vaitkutė Pavan, Eva Kalnina, Georg Scherpf, and Paulius Docka, FCIArb, we engaged in productive and intriguing discussions. ▪️ At first glance, the relatively small market of the Baltic States offers many opportunities for Big Law, starting with commercial #arbitration with English law as the governing law and ending with investment arbitrations. Big infrastructural projects, the implementation of EU sanctions, and the proactive involvement of investment screening commissions in the Baltic States will cause more international disputes.   ▪️ London as a seat is expensive for Baltic businesses. However, it is not a central topic of negotiation when the Baltic party has lower bargaining power. ▪️ #SCC, #ICC, and #LCIA arbitration clauses are the top 3 choices for Baltic international businesses.
