The Dubai Court of Cassation has provided an advanced interpretation concerning the enforcement of foreign judgments. In a recent ruling, issued last month, the Court of Cassation confirmed that the enforcement of a judgment issued by a foreign court is possible in UAE, despite the UAE Courts having jurisdiction over the subject matter dispute. The Court indicated in its reasoning that it is not sufficient, anymore, for the UAE Courts to have jurisdiction of the dispute, as historically understood and interpreted in Art. (235) of the Old Civil Procedures Code (now repealed). The new approach, adopted in the text of Art. (85) of the Executive Regulations of the Civil Procedures Code confirms that UAE Court would need to have "exclusive jurisdiction" over the dispute in order to reject enforcement of the foreign judgment. Why is this important? This new interpretation opens doors for a more advanced and developed approach by the UAE Courts, when it comes to the enforcement of foreign awards, which allows more security and assurance for parties who wish to resolve their disputes before foreign courts, but still seek enforcement in the UAE. #uae #dubai #courts #enforcement #judgments

The Saudi Data and Artificial Intelligence Authority has released a guiding report on the 100 top AI tools employees can use to enhace productivity and reinforce efficiency. The report highlights 100 AI tools that can be used in (12) main domains. They are: Accounting, Architecture, Cybersecurity, Design, Education, Human Resources, Law, Marketing, Medicine, Project Management, Programming, and Scientific Research. This is a very interesting report. I believe it indicates that the regulatory material, governing the use of AI tools in the Kingdom and across the MENA region, is not very far away from being adopted (especially with the EU approving its AI Regulations recently). This is a space to follow attentively. Things will start to change fast. You can find the report here: https://lnkd.in/dassybwn #ai #genai #dataprotection #saudiarabia #regulations #gcc #legalupdates

Morning breakfast well spent at Pinsent Masons office in Dubai, attending a great session titled “AI in the Workplace - A powerful but potentially risky tool”. They key message delivered by all the speakers was that “AI is here to stay”. Most companies and businesses are shifiting more of their activities and utilizing AI tools. However, from an Employment point of view, a lot of potential risks emerge (data, technology, confidentiality, and even discriminatory risks) with the rise of new technology trends, that can be a real pain for employers and businesses. Hence, the need for clear and adaptive policies around the responsible use of AI tools in all aspects of a business (legal, HR, sales, etc.). Thank you Luke Tapp , Martin Hayward, Alexandra Bertz, Michael Chattle, Liz Williamson, and David van Lochem for the valuable insights and very informative talk this morning. #uae #dubai #ai #genai #employment

A quick throwback to the Arab Lawyers Forum (ALF) event this past February ! I had the pleasure of meeting and interviewing Aarij S. Wasti, former Director of Legal & Compliance at FIFA World Cup Qatar 2022 and now Partner at Gowling WLG, Canada. You can find the interview (3 separate parts) at Thomson Reuters MENA or check the links below for quick access. The questions and discussion hovered over Generative AI and Sports Law. I very much enjoyed hearing Aarij's views and answers to 3 main questions: 1) How do you think Generative AI will affect sports law compliance in the GCC over the next few years? 2) Do you foresee the way sports lawyers' work will change in the future? 3) How do you think law firm partners can best support corporate counsel? Part I: https://lnkd.in/dW6PvNfP Part II: https://lnkd.in/dY8RuGe6 Part III: https://lnkd.in/d6SJB7gH More interviews from ALF to come.
