- Model releases. So, beyond the issue of whether somebody is a celebrity or whether there's something that's been written that's newsworthy, what are the other exceptions to the right of publicity law? Well, you can obtain a waiver from somebody and simply have them sign something that says you have the right to use their name, their likeness, and their voice. We often call this type of legal document a model release. When somebody is being photographed for a business promotion, for example, we ask them to sign a simple legal agreement allowing that company that hired them to use their image in the modeling shoot or in a promotional video. If you get a release signed, you should be free to use the image or video without being sued for right of publicity infringement.
