🚨 Breaking News: California Climate Rules #SB253 and #SB261, passed last year, have been amended to form #SB219. This new legislation will be pivotal to ensuring the bills maintain their current adoption timelines and address some of the criticisms the bills received in their current lawsuit and from California Governor Gavin Newsom. 🔍 Here’s a quick summary of what this means: - Extended Timeline: California Air Resources Board (#CARB) now has until July 1, 2025, to integrate SB 253 into the rule. - Cost Reduction: Reporting fees for SB 253 and SB 261 have been removed to lower business costs. - Streamlined Reporting: Companies can now consolidate SB 253 and SB 261 reporting at the parent company level. - Flexibility for CARB: CARB may, but is not required to, collaborate with external organizations for climate risk reports and public disclosure systems and now determines when companies share Scope 3 after Scope 1 and 2, which previously had a 180-day deadline. 🟢 Has the anti-ESG backlash peaked? A series of lawsuits against anti-ESG policies, growing evidence of their costs, and companies plowing ahead with their ESG programs (albeit less publicly) all point to a backlash to the #ESG backlash….(Backlash squared?) One area taking a hit is Diversity, Equity, and Inclusion (DEI). Some brands are backtracking on their #DEI policies, but is this a temporary reaction to public pressure, and will the DEI re-emerge? Plus, California’s legislature passed amendments to its climate disclosure laws, which await Governor Newsom's signature or veto by the end of the month. The changes mean there will be six more months for implementing rules but no more time for companies to report. The amendments to the voluntary carbon market law did not make it through, meaning the deadline in the law (now Jul 2025) is approaching quickly. US Presidential candidate Kamala Harris is under pressure from the left and right to reveal her climate agenda as she tries to walk the tightrope of appeasing climate activists while not seeming too liberal. Science Based Targets initiative releases the world’s first framework for building decarbonization amidst growing controversy around potential conflicts of interest between SBTi and its funders. This week, our good news comes from positive updates for the two main US climate reporting regulations, the SEC and California Climate Rules.   For the SEC, the positive news came from investor support from amicus briefs delivered to the 8th Circuit Appeals Court, reinforcing their claim that their climate rule is in response to investor needs for climate data.
