Conflict between parties can occur, when certain issues in the contact are not defined properly. Sometime, my activities are assumed to be part of maintenance practice, which are normally not correct. When contractor don't agree to your assumptions, which is not explicitly defined leads to disagreement and Conflict starts. Hence, contracts should be properly drafted without giving any ambiguity. Also, during negotiation, vendors should be apprised about your assumptions and each others view points should be recorded to avoid any future Conflict. Even after taking all precaution, there can be Conflict and it should be mutually solved through negotiation within contractual guidelines and within applicable laws.

2 Open Dialogue

Once you have pinpointed the issues, initiate an open dialogue with the vendor. Effective communication is key to resolving conflicts. This means not only expressing your concerns clearly but also actively listening to the vendor's perspective. Aim to create a collaborative environment where both parties can discuss the problem without defensiveness. Remember, the goal is to arrive at a solution that is acceptable to all involved, not to assign blame.

Improper communication can lead to Conflict. But such Conflicts can be solved through mutual discussion across the table. But, different interpretation of terms of contracts by either parties, generally leads to serious Conflicts. In that situation, negotiation, Building trust and faith plays important role. Many times, during critical situation, assigning additional jobs without clarity leads to serious complications. Hence should be judiciously thought up to avoid future complications.

While drafting a fresh contract, if similar contracts were executed earlier, the terms and conditions of earlier contracts to be reviewed with their Performance. Any specific changes required should be carefully thought up. However, once contract is formed, it's difficult to revise without mutual discussion within framework of law and contracting procedures and guidelines.

Building good relationship and good faith with vendors can solve many issues in facilities maintenance. Generally in maintenance contract, defining actual requirements are generally difficult. hence certain aspects to be managed by both parties. Here, good relationship and faith plays a role. Mutual help in the time of need build a strong relationship.
