As many of you are aware, residency visas are typically valid for a period of 2 years. As per the current law, those who fail to leave the country or renew their visas prior to their visa expiry are subject to pay overstay fines. Positively, the UAE has announced the introduction of a two-month grace period, effective from September 1st 2024. During this period, individuals with expired residency visas have the opportunity to either renew or exit the country without incurring any overstay fines or legal penalties. The UAE continues to enhance regulations, this specific initiative greatly reduces financial burdens whilst offering flexibility to residents. What do you need to know about leave in the UAE, calendar days versus working days: 1. Employment Agreement: Ensure your employment agreement specifies your annual leave entitlement as either calendar or working days. 2. UAE Labour Law Compliance: As per UAE Labour Law, annual leave is calculated based on calendar days, although in common practice companies convert this to working days. Make sure to familiarise yourself with both the Labour Law and your agreement to understand your entitlement. 3. Monthly Leave Accrual: Whether your company calculates leave based on 30 calendar days or 22 working days, both options represent the same time frame. 4. Public Holidays: As per UAE Labour Law, employees are entitled to paid leave on public holidays. However, for calendar days, public holidays are considered part of the annual leave if they fall within the dates of the leave.
